WE DO REQUIRE A DEPOSIT OF 30% FOR ALL RENTALS TO SECURE YOUR ITEMS AND COMPLETE YOUR RESERVATION. THE DEPOSIT IS NONREFUNDABLE IF YOU CANCEL FOR ANY REASON THEN YOU WILL BE GIVEN A CREDIT TO USE FOR UP TO 1 YEAR FROM THE RENTAL DATE.

YOU CAN CANCEL 24 HOURS BEFORE YOUR RENTAL TIME AND YOUR DEPOSIT WILL BE ISSUED AS A CREDIT FOR UP TO 1 YEAR FROM THE RENTAL DATE. IF WE ARRIVE AND YOUR EVENT LOCATION AND YOU DECIDE TO CANCEL THEN YOU WILL LOSE YOUR DEPOSIT. YOU ARE CHARGED FULL PRICE IF WE SET UP REGARDLESS IF THE ITEMS ARE USED OR NOT.

IF YOU CANCEL ANY ITEMS ON YOUR ORDER, YOU MUST DO SO 72 HOURS BEFORE YOUR EVENT OR YOU WILL INCUR A 30% RESTOCKING FEE, THIS WILL GIVE US TIME TO RENT THOSE ITEMS TO ANOTHER CUSTOMER.

WE RESERVE THE RIGHT TO CANCEL ANY ONLINE BOOKING FOR ANY REASON. FOR EXAMPLE, ONE THAT DOES NOT MEET OUR MINIMUM AMOUNT OR IS OUTSIDE OUR DELIVERY AREA. THE CUSTOMER WILL BE NOTIFIED PRIOR AND A FULL REFUND WILL BE ISSUED.

WE RESERVE THE RIGHT TO CHANGE THE PRICING IF AN ONLINE BOOKING IS INACCURATE. ALL CUSTOMERS WOULD BE NOTIFIED AND CONTACTED BEFORE WE MAKE ANY CHANGES. EG. YOU DIDN'T SELECT A PARK RENTAL/PUBLIC VENUE, WHICH IS A $50 FEE AND YOUR RENTAL IS AT A PUBLIC VENUE.

THE CUSTOMER ACKNOWLEDGES THAT S/HE HAS RECEIVED IN GOOD ORDER ALL RENTED ITEMS AND OTHER GOODS LISTED ON THE CONTRACT.

CUSTOMER ASSUMES FULL RESPONSIBILITY FOR ALL RENTED ITEMS, INCLUDING THEIR SAFE AND PROPER USE, OPERATION, MAINTENANCE, AND RETURN TO FUNTESTY. CUSTOMER IS RESPONSIBLE FOR ALL LOSS, DAMAGE, OR REPAIR.

FUNTESTY MAKES NO WARRANTIES OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OR ANY WARRANTIES, EXPRESSED OR IMPLIED.

THE RENTAL CONTRACT IS THE SOLE AGREEMENT BETWEEN THE CUSTOMER AND FUNTESTY. THE CUSTOMER AGREES TO INDEMNIFY AND HOLD FUNTESTY HARMLESS FOR ANY CLAIMS FROM CUSTOMERS USE OR MISUSE, INCLUDING ANY THIRD PARTIES FOR LOSS, INJURY, AND DAMAGE TO PERSONS OR PROPERTY ARISING OUT OF THE CUSTOMER'S NEGLIGENCE OR OPERATION INCLUDING LEGAL COSTS INCURRED IN DEFENSE OF SUCH CLAIMS.

OPERATORS SHOULD READ ALL WARNINGS AND INSTRUCTIONS (SAFETY INSTRUCTIONS).

RETAKING OF EQUIPMENT: IF CUSTOMER FAILS TO RETURN ALL RETURNED ITEMS UPON AGREED TIME, CUSTOMER AGREES TO PAY FOR ALL ADDITIONAL CHARGES. IF CUSTOMER REFUSES TO RETURN RENTED ITEMS, THE CUSTOMER AGREES THAT FUNTESTY AND ITS AGENTS MAY TAKE ALL REASONABLE ACTIONS NECESSARY TO RECOVER RENTED ITEMS WITHOUT PRIOR NOTICE OR LEGAL PROCESS.

CUSTOMER ACKNOWLEDGES THE POSSIBILITY OF INJURY AND WILL PROVIDE ADULT SUPERVISION AT ALL TIMES ACCORDING TO THE RULES GIVEN TO RENTAL PARTY PRIOR TO EVENT, WRITTEN INSTRUCTION, OR VERBAL.

ATTORNEY FEES: CUSTOMER AGREES TO PAY ALL REASONABLE ATTORNEY FEES AND COURT COSTS INCURRED BY FUNTESTY IN ENFORCING THESE TERMS AND CONDITIONS.
